These Terms of Service, including any referenced or attached exhibits, appendices and policies (collectively, the “Agreement”), form a binding agreement between WASK BİLGİ TEKNOLOJİLERİ ANONİM ŞİRKETİ. and our affiliated companies (collectively, “Wask,” “we,” “our,” or “us”) and the person or entity agreeing here to (“Customer,” “you,” or “your”).
This Agreement governs all access to and use of the Wask website located at www.wask.co (“Website”), the Wask All-in-One Ads Platform that we make available via the Wask Website for purposes of management, monitoring, and execution of marketing campaigns, and all other Wask services, technology, data, programs, and materials (collectively, “Services”). We rely on legitimate interests to improve our services, detect fraud, and ensure security; compliance with legal obligations to meet regulatory requirements such as tax filings; and contractual necessity to fulfill our agreements with you, such as processing transactions or providing access to integrated advertising platforms.
This Agreement is effective as of your initial access to or use of the Services or upon execution of an Order hereunder, whichever is earlier (the “Effective Date”). Wask and you are each a “Party” and collectively, the “Parties.”
Please read this agreement carefully. By accessing or using the services, you represent that: (i) you have read, understood, and agree to be bound by this agreement, as we may amend it from time to time; (ii) under the laws of the jurisdiction where you reside, you are old enough to enter into a legally binding agreement; and (iii) you have the authority to enter into and be bound by this agreement personally and, if applicable, on behalf of any person or entity that you identify to us as the customer in the applicable Wask account record, billing statement, online subscription process, or order. If you do not agree to be bound by this agreement, you may not access or use the services.
By clicking the 'I Accept' button or downloading the respective program/service, installing it on a computer, phone, or any platform where the program/service can be used, or by accessing or using the program/service, you acknowledge and agree to the terms of service and Wask's Privacy Policy, including the additional terms and policies provided by Wask from time to time. This agreement and all terms contained herein (including this clause) are considered read, understood, and accepted as a condition of using the service.
If the terms outlined in this agreement are not suitable for your intended use or you do not accept the agreement, you are not authorized to use the service provided by Wask. Your use of the service and/or the direct provision of the service by Wask signifies that both you and Wask are bound by the terms outlined in this agreement. Ad Account: Any user account registered with an 'advertising network.'
Advertising Network: A third-party advertising platform (e.g., Instagram, Meta/Facebook, Google) associated with an ad account and providing related services as defined under this agreement.
Ad Spend: The total amount incurred on all the user’s advertising accounts, regardless of actual usage and/or spending.
Add-On: Refers to any additional product or service developer available for purchase, not limited to the listed services.
Affiliates: Any entity directly or indirectly controlling, controlled by, or under common control with a party to this agreement. Control refers to the direct or indirect ownership or control of more than 50% of the entity's voting rights.
Confidential Information: Includes all confidential information disclosed by one party (discloser) to the other (recipient), except where such information was independently developed by the recipient without obligation to the discloser or legally obtained from a third party. User Data under this agreement will also be considered 'Confidential Information.'
Customer Data: All data sent or collected through service providers. Customer Data does not include Wask.co content.
Personal Data Protection Act: Refers to universal data protection and privacy regulations applicable to the processing and usage of personal data, subject to changes, repeals, or consolidations over time.
Feedback: Any feedback, suggestions, ideas, advice, development requests, data, statistics, or other information you may provide about the services.
Free Services: Trial packages or services explicitly mentioned as free, along with other free features provided to users.
Intellectual Property: All patents, copyrights, trade secrets, trademarks, service marks, trade names, goodwill, marketing rights, works of authorship, discoveries, improvements, methods, designs, techniques, derivative works, know-how, and any related proprietary rights (whether registered or not).
Wask Content: Any information, data, text, software, sound, video, image, or labels provided, made available, or included in the offered services.
Main Account: Refers to the primary Wask account linked to the advertising accounts.
Purchase: The subscription or purchase approval process for services covered under this agreement, confirmed via a numbered and Wask-approved order form.
Personal Data: Includes information within Customer Data considered personal under applicable Data Protection Laws, tied to an identifiable or identified individual.
Platform: The proprietary platform of Wask used for managing advertising strategies, campaigns, and related activities, including updates and enhancements.
Refund: The return of a user payment by Wask.
Security Breach: Any accidental or illegal destruction, loss, alteration, unauthorized disclosure of, or access to Customer Data under our control.
Sensitive Data: Includes credit/debit card numbers, financial account details, government-issued IDs (e.g., Social Security, passport), biometric or health data, children's personal information, or other categories defined under applicable Data Protection Laws.
Subscription: A recurring subscription granting access to services per this agreement, based on an order (monthly, quarterly, or annually), unless canceled.
Term: Refers to the initial term of your subscription as specified in the applicable orders and any subsequent renewal terms.
Third-Party Services: Software, applications, and/or services provided or licensed by third parties that can be integrated or used in conjunction with the services.
To use the services provided by Wask, you must be at least 18 years old. By accepting the terms of this agreement, you declare and guarantee to us that:
You are at least 18 years old.
Your account has not been previously suspended or prohibited from accessing the service.
Your registration and use of the services comply with all applicable laws and regulations.
If you are a legal entity, organization, or company, the individual accepting these Terms on your behalf declares and guarantees that they have the authority to act and contract on your behalf. In such cases, references to "you" (and all obligations under the agreement) will apply to the legal entity and any individuals using the service on behalf of that entity.
To access the services provided by Wask, you must have an account. When creating an account to register with Wask, you will be asked to provide personal data, including your name, email address, and other contact details. You agree that the information you provide is accurate and that you will keep it updated at all times. Upon registering with Wask, you will be required to set a password to access the system. You are solely responsible for maintaining the confidentiality of your account and password, as well as accepting responsibility for all activities occurring under your account. If you believe your account is no longer secure, you must immediately notify us at support@wask.co
Users initiating a subscription agree to pay the recurring monthly fee via credit card or an alternative payment method entered into the system. Refunds will not be issued for reasons such as forgetting to cancel a subscription or failing to use the software. Wask reserves the right to modify its subscription plans and may do so at any time. Users will be informed of any changes in subscription plans, and if they do not cancel their subscription, they will be charged the new fee. All users registering with Wask agree to allow the use of communication channels like email and phone for marketing purposes. Users unwilling to consent can change their preferences within the software. Wask is not responsible for any technical issues advertisers may face in their advertising accounts after using the software.
We reserve the right to make changes to any Wask service, policy, or the terms and conditions included in these Terms of Use. The terms and conditions, policies, and Terms of Use applicable at the time of using the services provided by Wask will apply to you. If any clause of the Terms of Use is deemed invalid, void, or unenforceable for any reason, that clause will be considered severable and will not affect the validity or enforceability of the remaining clauses.

The starter, business, and agency features of the service require payment at the time of subscription. Before any payment is processed, you will have the opportunity to review and accept the charges. All fees are in U.S. dollars and nonrefundable. Pricing varies depending on the plan and is designed differently for individual users and organizations.
Wask reserves the right to set prices for its services. Wask makes and will continue to make reasonable efforts to keep pricing information published on its website up-to-date. We recommend regularly checking our website for the latest pricing information (http://wask.co/pricing). Wask may, at its sole discretion, notify you in advance of changes to base or additional fees for any features of the service before implementing the changes. Wask, at its discretion, may offer promotional deals with different features and prices to specific customers. These promotional offers will not apply to your subscription or these Terms unless expressly offered to you.
You authorize Wask to charge all amounts for the services ordered and the service level selected under these Terms or as published by Wask to your payment method.
Wask will make every effort to ensure uninterrupted accessibility and error-free transmissions. However, due to the nature of the internet, this cannot be guaranteed. Additionally, access to the services provided by Wask may be suspended or restricted at various times for repairs, maintenance, or the introduction of new features or services. The frequency and duration of such suspensions or restrictions will be minimized and will not significantly affect usage.
Wask shall not be responsible for (i) damages arising out of circumstances beyond its control, (ii) loss of business (including loss of profits, income, contracts, anticipated savings, data, goodwill, or wasted expenses), or (iii) indirect damages unforeseen at the time you started using the services provided by Wask.
Wask shall not be liable for damages arising from the free tools and free usage options offered on its website and software.
If Wask is delayed in or unable to fulfill its obligations under these terms for reasons beyond its reasonable control, it will not be liable for such delays or failures. This provision does not affect your statutory rights to a refund or compensation if goods or services are not provided within a reasonable time or due to reasons beyond our reasonable control.
Certain jurisdictions may not allow some of the limitations outlined above, either partially or fully. If you connect from one of these jurisdictions, all or part of the above limitations may not apply to you, and you may have additional rights.
Customer Data Protection: Wask implements and maintains reasonable physical, technical, and organizational safeguards to protect your personal data. As part of your subscription, Wask may store your data in specific locations or regions (e.g., North America or Europe) under the terms of these conditions. Wask and its Affiliates may transfer customer data (including personal data) to the United States in connection with the services.
Sensitive Information: Users acknowledge that the services provided by Wask are not designed to process or manage sensitive information. Users agree not to use the services for uploading, collecting, managing, or processing sensitive information. Wask explicitly disclaims all liability arising from users’ use of the services for such purposes.
Usage Data: Wask may collect, use, share, and disclose usage data for various purposes, including but not limited to calculating fees, scope analysis, monitoring activities, and improving the services.
Security Breaches: If either party becomes aware of a security breach, the affected party must notify the other immediately (and in any case within 72 hours) unless prohibited by law or instructed otherwise by a law enforcement or regulatory authority. The notifying party must also promptly take reasonable steps to investigate and mitigate the impact of the breach.
In addition to these and any future Terms of Use, the software terms will apply to any software (“Wask Software”) we make available for your access, including updates and upgrades related to Amazon Services or other applicable services.
All content included in or made available through any Wask service—such as text, graphics, logos, button icons, images, audio clips, digital downloads, and data compilations—is the property of Wask or its content suppliers and is protected by international copyright, authors' rights, and database rights laws. The compilation of all content available through Wask services is the exclusive property of Wask and is protected by international copyright and database rights laws.
You may not extract or reuse parts of any Wask service content without express written permission from us. Specifically, you may not use any data mining, robots, or similar data gathering and extraction tools to extract any substantial portion of content (once or multiple times) of any Wask service without our express written permission. Additionally, you may not create or publish your database containing substantial parts of any Wask service content without our express written consent.
Wask respects the intellectual property rights of others. If you believe your intellectual property rights are being infringed, please contact us at support@wask.co.
Subject to your compliance with these Terms of Use and any applicable fees, Wask or its content providers grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and make personal and non-commercial use of the services provided by Wask. This license does not include the resale or commercial use of any Wask service or content, collection and use of product listings, descriptions, or prices; derivative use of any Wask service or its contents; downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools.
All rights not expressly granted to you in these Terms of Use remain reserved and protected by Wask or its licensors, suppliers, publishers, rights holders, or other content providers. No part of any Wask service or its content may be reproduced, copied, sold, resold, visited, or otherwise exploited for commercial purposes without express written consent from Wask
In the event of riots, embargoes, government interventions, rebellions, occupations, wars, mobilizations, strikes, lockouts, labor disputes, or boycotts, including labor-employer disagreements, cyberattacks, communication issues, infrastructure and internet failures, system improvements or upgrade works, and resulting disruptions, power outages, fires, explosions, storms, floods, earthquakes, migrations, epidemics, or other natural disasters, or any other events beyond Wask's control that are not due to its fault and could not reasonably have been foreseen ("Force Majeure"), if Wask is unable to fulfill or delays fulfilling its contractual obligations due to Force Majeure, Wask shall not be held liable for obligations hindered or delayed as a result of the Force Majeure, and such circumstances shall not be deemed a breach of contract.
If you violate these Terms of Use and we do not take action, we will still retain our rights and legal remedies to act in any case of your violation of these Terms.
